Try calling your ISP and asking them to check your SNR numbers. You might ask them for the numbers themselves and do some research before so that you can interpret them. I suppose it is possible that at certain times of the day there is line noise that is not present at other times of the day. So, try to call them when you're having the lag issue.
While you're on the phone with them, you might ask them what to look for as evidence that your neighborhood line has been oversold, since you're getting lag during peak times of the day and if there's anything to be done about it or if the least you can do is issue a complaint so that they're aware of the problem.
